Privacy information for california residents

If you are a California resident, the California consumer privacy act (“ccpa”) requires us to provide you with the following additional information about (1) the purpose for which we use each category of “personal information” (as defined in the ccpa) we collect; and (2) the categories of third parties to which we (a) disclose such personal information for a business purpose, (b) “share” personal information for “cross-context behavioral advertising,” and/or (c) “sell” such personal information. under the ccpa, “sharing” is defined as the targeting of advertising to a consumer based on that consumer’s personal information obtained from the consumer’s activity across websites, and “selling” is defined as the disclosure of personal information to third parties in exchange for monetary or other valuable consideration.  as discussed in the "online analytics and advertising" section above, our use of third-party analytics services and online advertising services may result in the sharing of online identifiers (e.g., cookie data, ip addresses, device identifiers, and usage information) in a way that may be considered a “sale” or "sharing" under the ccpa.

Your choices regarding “selling/sharing.”  you have the right to opt out of our sale/sharing of your personal information for purposes of online analytics and advertising by clicking here.  to opt out of the offline disclosure of your information to third parties for these purposes, please contact us using the information in the "contact us" section below.   you will need to exercise your opt out rights for each ascend service you use, and on each browser and device you use to access such services.

 

please note that if you have a legally-recognized browser-based opt-out preference signal turned on via your device browser, we recognize such preference in accordance with applicable law.

 

Sensitive information.  the ccpa also allows you to limit the use or disclosure of your “sensitive personal information” (as defined in the ccpa) if your sensitive personal information is used for certain purposes.  please note that we do not use or disclose sensitive personal information other than for purposes for which you cannot opt-out under the ccpa.

 

Notice concerning do not track.  do not track (“dnt”) is a privacy preference that users can set in certain web browsers. we are committed to providing you with meaningful choices about the information collected on our websites for third-party purposes, and that is why we provide the variety of opt-out mechanisms listed above. some web browsers offer users a “do not track” privacy preference setting in the web browser. we do not currently recognize or respond to browser-initiated do not track signals. please note that do not track is a different privacy mechanism than the “global privacy control” browser choice referenced above, which is a browser-based control that indicates whether you would like to opt out of the disclosure of your personal information for certain purposes.

Financial incentive programs.  the services may offer opportunities to receive certain services or benefits such as discounts or free trial services, which may require the provision of personal information. such opportunities could be considered “financial incentives” under California law (each, an “incentive program”).  when you participate in an incentive program, you will be asked to agree to the terms of that incentive program and may revoke your participation depending on the incentive program. to the extent we can determine the value of your information, we consider the value of providing you with a more personalized experience as well as the expenses we incur in providing incentive programs that are reasonably related to the costs associated with offering the incentives.

 

California “shine the light.” California residents can also request a list of all the third parties to which we have disclosed certain personal information (as defined by California’s shine the light law) during the preceding year for those third parties’ direct marketing purposes. california residents may contact us using the contact information provided below. in the body of your request, you must include: “California shine the Light request”, your name, a current California address including street address, city, state, and zip code, as well as sufficient information for us to determine if the law applies to you. you will need to attest to the fact that you are a California resident. we will not accept requests by telephone, email, or facsimile, and we are not responsible for notices that are not labeled or sent properly, or that do not have complete information.
 

Information for international users

Unique Nursing has its headquarters in the united states. we may transfer your information to affiliates, service providers, and other third parties located outside of your country of residence, including in the united states. this is necessary to provide our services and for the purposes outlined in this privacy policy.  data privacy laws vary from country to country and may not be equivalent to, or as protective as, the laws in your home country.  we take steps to ensure that reasonable safeguards are in place to ensure an appropriate level of protection for your information, by applicable law. these measures include data transfer agreements. by providing us with your information, you acknowledge and expressly agree to any such transfer, storage, or use.

Updates to our privacy policy

We reserve the right to amend this privacy policy at any time to reflect changes to our practices or the law. please check the services periodically for updates.  the date at the top of the privacy policy tells you when it was last materially updated. if we make material changes to the way we collect or use your information, you will be provided with appropriate notice, including by, but not limited to, posting the updated policy on the services, and providing notice in accordance with legal requirements. any changes to this privacy policy will become effective when the revised privacy policy is posted.  by continuing to use the services following any changes to this privacy policy, you acknowledge you have read and understand the updated privacy policy, and you understand that we will collect, use, and disclose information as stated therein.

The terms and conditions set out below are a legal agreement ("Agreement") between you and unique nursing and govern your use of this website, any unique nursing products and services, and related materials, whether delivered by shipment or accessed online, including, but not limited to, unique nursing books and ebooks, course content, instructional and test preparatory materials, surveys and questionnaires, videos, tutorials, testing and assessment materials, and related ati resources made available to you by unique nursing, including but not limited to, through unique nursing’s website and/or online hosted platform and related customer services. Unique Nursing is a u.s.-based business, operating in and from the united states.

Your unique nursing membership account

Prior to creating an account with unique nursing ("Account") for your use of unique nursing products and services, you will be required to provide certain information, establish a username and password, and may be provided with access codes and product codes by unique nursing. when establishing your account, you agree to provide complete and accurate information to unique nursing and to permit unique nursing to store and use your registration data for use in maintaining your account. you agree to notify unique nursing of any changes in your personal or registration information. you agree to protect your username and password, as well as any access codes and product codes provided by unique nursing, and not share them with others or permit any unauthorized use of unique nursing products or services. if you have reason to believe that someone is using your account without your permission, you should contact unique nursing immediately. unique nursing will not be responsible to you or any third party for any loss or damage resulting from your failure to notify unique nursing of unauthorized use or from your allowing others to use and/or not adequately protecting your password, access codes, or your account with unique nursing. By establishing an account, you certify and represent that any exam, test, assessment, or other interactive tool offered through unique nursing products will be completed and utilized only by you and you will not permit any other person to falsely answer exam, test, and assessment questions under your name. 

Intellectual property

You understand and agree that unique nursing products and unique nursing services constitute intellectual property and proprietary material that is owned by unique nursing or its licensors and is protected under intellectual property laws in the United States and other countries, which includes but is not limited to, copyright. all rights not expressly granted to you under this agreement are reserved by unique nursing and its licensors.

Before establishing an account with unique nursing products, you are required to agree to the following terms around use of certain data, as described below:

Your contact data

You understand and agree that unique nursing will collect and may use personally identifiable information including, but not limited to, the following: name, address, phone number, fax number, email address, employer, title, user id and password, and ip address. we use this information to provide the highest quality of service to you, and so that we can verify your identity, contact you, provide materials to you upon your request, register you, send relevant messages via e-mail, phone, or post, or for any other purpose identified in this policy or when personal information is collected. unique nursing may contact you via email, text, or phone in order to notify you of important timely information or upcoming deadlines. unique nursing or a third party engaged by unique nursing also may contact you via surveys, sweepstakes offers or other data collection techniques to conduct research about your opinion of current unique nursing products and services, of potential new services that may be offered or topics of interest in your field. we may ask you to provide demographic information at your option; such information is generally used in aggregate form for various analyses conducted by unique nursing regarding our products and services.
 

General usage data: 

You also understand and agree that, through unique nursing products and services and the use of other third-party software,  unique nursing may collect diagnostic, technical, and general unique nursing products and services usage information, such as cookies, content viewed, ip address, device use, site volume, and load, that is gathered to (i) facilitate unique nursing’s product support and software development, and improve unique nursing products and services, (ii) verify compliance with license terms, (iii) monitor, record and report information about unique nursing products user activity and engagement with the unique nursing products, services sites, modules, and social media pages, (iv) collect information around device use, unique nursing products site volume and load, and user results in connection with certain unique nursing products features or material ("general usage data").

information you provide or post

Unique Nursing welcomes your suggestions and input on how we might improve the unique nursing properties, services, and products. by providing any such suggestions, ideas, know-how, and input to unique nursing, you agree that unique nursing, including its parent and affiliated companies, has a royalty-free, perpetual, worldwide, irrevocable right to use, publish, create, display, market, distribute, copy, and sell the same, in any form, medium, or technology, whether now known or developed in the future

Privacy Policies

Unique Nursing will not sell, rent, trade or lease your personally identifiable information (“your personal information”) to others unless we have requested to do so and have received your permission. (aggregated information, by definition, is not identifiable and thus is not included in the definition of your personal information.) notwithstanding the foregoing, unique nursing reserves the right, and you hereby grant unique nursing the right, to disclose your personal information to others under the following circumstances: (i) we may share your personal information with any unique nursing affiliate (or business partner or agent acting on our behalf) worldwide and such affiliates, business partners, and agents will be under the same obligations as is unique nursing to protect the confidentiality of your information and protect your privacy.
